We are pleased to announce the appointment of Sarah Petersen to the STBB team in East London/King Williams Town.

Sarah is an experienced conveyancer who has, for the past seven years, been practising for her own account under the name and style of Kriel Petersen Attorneys in East London. Sarah brings with her valuable experience and will assist Nikhail Munsamy in the daily running of the East London/King Williams Town Office.

Drafting of Deeds in English

Please take note that the Registrar of Deeds: Cape Town issued the attached notice on 23 February. It is a request for conveyancers to draft deeds and documents submitted to that office in English, necessitated by the fact that there are too few examiners in that registry who are adequately conversant in Afrikaans for purposes of examining deeds.

This request has also been communicated to the Property Law Committee of the Cape Law Society and they have indicated that they understand and support the request.

Regulation 35(2) of the Deeds Registries Act, quoted below, must however still be complied with.

Reg 35(2) “Conditions must therefore be inserted in deeds in the official language in which they were constituted, provided that where any conditions are embodied in a registered deed in another official language, such language may be perpetuated in subsequent deeds.

Conveyancing Targeted By Scammers | 23 February 2017

There are troubling statistics regarding the steady increase in online fraud in conveyancing transactions. Bearing in mind that the Attorneys Insurance Indemnity Fund issued a statement last year that it would no longer cover ‘cyber crimes’ with effect from July 2016, there is escalating pressure on conveyancing firms to combat this form of fraud.

Read Carmel Rickard’s note on a recent judgment here, where the sellers approached the court for an order that the conveyancing firm be held liable for their losses after they fell victim to such a scam.

Deeds Office Circular On Amended Sectional Titles Act | 13 October 2016

Herewith Chief Registrar’s Circular No 13 of 2016 dealing with changes to the Sectional Titles Act by the Sectional Titles Schemes Management Act 8 of 2011.

Particular attention should be paid to the following provisions:

  • the section 15B(3) certificate;
  • the developer’s real right to extend;
  • lodging of rules; and
  • changes to Form W.
