We attach a list of the Registrars’ Conference Resolutions of 2015 for your attention. Practice is that the resolutions come into effect early on in the new year and we will confirm once the January 2016 date of coming into operation has been made public.

Recent amendments to the regulations of the Sectional Titles Act will be effective from 1 August 2015 onwards. If you are in the process of drafting documents in respect of one of the prescribed Forms, follow the amended Forms. Deeds already in the deeds office or already signed, need not be amended, as these precede the above-mentioned date.
The amendments can be viewed HERE. The blue underlining shows the amendments to the regulations and the pink underlining shows additions to the various prescribed Forms in the Act.

Cape Town Deeds Office holiday closure dates
The Cape Town Deeds Office has issued a notice in terms of their closure dates over the holiday season, the basics of which are set out below:
- Deeds Office Christmas party takes place on 15th December 2014, meaning registrations only on that date, no lodgements or hand-ins.
- The last day to register is 19th December 2014.
- The last day to lodge is the 18th December 2014.
- Closed for holiday season from 22nd December, opening again on 5th January 2015.

Change in legislation Section 80 of Administration of Estates Act
Government Gazette 38238 of 24 November 2014 reports an important change to the legislation in terms of Section 80 of the Administration of Estates Act 66 of 1965.
In the past, a minor who sought to sell or mortgage an immovable property, where the value was less than R100 000, could do so with the assistance of a parent or legal guardian, as well as the authorisation of the Master. In cases where the value of the immovable property exceeded R100 000, the authorisation of the High Court was required. This amount has increased to R250 000, with effect from 24 November this year.
